MacLeay Construction Lies

MacLeay Construction butchered my new home in Sharon, Connecticut:

Here are some pictures of what MacLeay Construction contended was a heavily wooded site with no topsoil. MacLeay was trying to justify their high costs and their failure to stockpile the topsoil so it could be saved and reapplied after the work. What do you think: heavily wooded? No topsoil?

In addition, I am trying to post documents from our interaction with MacLeay Construction, detailing their ineptitude. These will include a copy of one of the final drafts of our contract. You will note it is NOT an AIA-approved contract, which is pretty standard in the industry. If you see something like this from MacLeay Construction RUN AWAY! It is very one-sided. I am an attorney and I could not catch all the details that work against an owner.

Here is a site sketch that MacLeay Construction tried to use to do the excavation for our new home:

Is it any wonder they overdug the hole and put it in the wrong place?
I will also try to post a copy of the judgment we received, holding MacLeay Construction responsible for the damage they did. Of course, once the award was handed down, MacLeay Construction has not paid a dime and MacLeay has not answered a single phone call or e-mail.

Here is a copy of my termination letter sent to MacLeay Construction. This was after approximately three and one-half months of MacLeay working on my new home project. The letter highlights some of the problems I had with MacLeay Construction, and why they had to be fired.  The funny (or sad?) thing is, my offer to MacLeay in this letter was more than fair; had MacLeay done the honorable thing and accepted responsibility for their errors, they would have saved money. We were awarded much more money at arbitration than I was willing to settle for in this letter.
